Introduction

These Terms of Service explain the conditions that apply when you use roseyskin.co, create an account or purchase from Rosey.

They work alongside our Privacy Policy, Shipping & Returns information and 14-Day Money-Back Guarantee. Nothing in these Terms limits a right or remedy that cannot lawfully be limited, including your rights under Australian Consumer Law.

1. About these Terms

Rosey Skin is operated by Coreena Duncan, ABN 79 161 557 644, trading as Rosey Skin, of Office 3018, 470 St Kilda Road, Melbourne VIC 3004. In these Terms, Rosey, we, us and our refer to that business.

These Terms apply when you visit roseyskin.co, use a feature made available through the site, create an account or purchase a Rosey product. By using the site, you agree to these Terms.

If you place an order for someone else, you confirm that you have their authority to provide the information needed to fulfil it.

You must be at least 18 years old to place an order, or have the permission and supervision of a parent or legal guardian who accepts these Terms on your behalf.

2. Using the site

You may use the site only for lawful purposes.

You must not:

• interfere with the security or operation of the site
• introduce malicious code or use automated tools to scrape, copy or overload the site without permission
• attempt to access another person’s account or information
• submit unlawful, abusive, fraudulent or misleading material
• infringe another person’s rights
• purchase Rosey products for unauthorised commercial resale

You are responsible for the accuracy of the information you provide and for ensuring that you are authorised to use the payment method selected at checkout.

3. Products and information

Rosey takes care to describe its products accurately, including their size, ingredients, directions, price and any included offer. Colours, scale and finish may appear differently depending on the screen or photography. Packaging may be updated from time to time.

Always read the directions and ingredient list on the product you receive, particularly if you have a known sensitivity. Patch test first and record the result in your Rosey Skin Journal. Stop using a product if irritation occurs.

Information on the site is general cosmetic and educational information. It is not medical advice and is not intended to diagnose, treat or prevent a medical condition. Seek advice from an appropriately qualified health professional if you are concerned about your skin or health.

4. Orders and availability

Products are offered subject to availability. Adding an item to your cart does not reserve it.

After you place an order, Shopify will send an acknowledgement to the email address you provide. That acknowledgement confirms that the order has been received. Rosey accepts your order when we send a dispatch confirmation, unless the law requires the contract to be treated as formed earlier.

Before an order is accepted, Rosey may decline it where reasonably necessary, including because:

• a product is unavailable
• payment is not authorised or appears fraudulent
• the delivery address cannot be serviced
• the order breaches a stated purchase limit or appears intended for unauthorised resale
• there is an obvious and genuine pricing or product-information error
• accepting the order would breach a legal or regulatory requirement

If Rosey cannot accept an order after taking payment, we will contact you and refund the affected amount. We will not substitute a different product or gift without your agreement.

5. Prices and payment

Prices are shown in Australian dollars and include GST where applicable. The total payable, including any delivery charge, discount and tax, will be shown before you confirm the order.

Payment is processed using the methods available at checkout. Your bank or payment provider may apply its own terms or fees.

Rosey will not charge a higher undisclosed price after an order has been accepted. If more than one price is displayed for the same product, Rosey will apply the requirements of Australian Consumer Law.

6. Delivery

Rosey offers free shipping on Australian orders and aims to dispatch within two-four business days. Delivery timeframes begin after dispatch and are estimates unless expressly stated otherwise. Weekends, public holidays, remote locations, carrier disruptions and events outside Rosey’s reasonable control may affect delivery.

You are responsible for providing a complete and accurate delivery address. Contact Rosey as soon as possible if it needs to be corrected. An address cannot always be changed once fulfilment has begun.

7. Changes and cancellations

Contact Rosey as soon as possible if you need to change or cancel an order. Include your order number. We will do our best to help before dispatch, but a change or cancellation may not be possible once fulfilment has begun.

Rosey will not make a material change to an accepted order without contacting you. If we cannot supply what was accepted, we will explain the available options. These may include waiting, accepting an alternative you approve or receiving a refund for the affected item.

8. Returns and consumer rights

Rosey products come with consumer guarantees that cannot be excluded under Australian Consumer Law. Depending on the circumstances, you may be entitled to a repair, replacement, refund, cancellation or compensation if a product does not meet an applicable guarantee. These rights are not limited to 14 days.

Rosey’s 14-Day Money-Back Guarantee is an additional promise. It does not replace or limit your rights under Australian Consumer Law.

If a formula purchased directly from roseyskin.co is not right for your skin, stop using it and contact Rosey within 14 days of delivery. Include your order number, the product name and a short description of what happened. Rosey will respond within two to three business days and arrange a refund of the amount paid for the eligible formula. Do not return a product before Rosey provides instructions.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

9. The Rosey Duo and Compact Mirror Discounts

Purchase any two Rosey formulas and receive 10% off the formulas, plus the compact mirror at no additional cost. Add your two chosen formulas and the mirror to your cart. The savings will be applied automatically at checkout.

The first 300 eligible Rosey Ritual Duo purchases receive a limited-edition Rosey compact mirror valued at $39.95. The compact mirror is available only while the allocated stock lasts. Purchasing either formula individually does not qualify.

If the complete qualifying Duo purchase is refunded under the 14-Day Money-Back Guarantee, the compact mirror must also be returned. If only one formula is eligible for a refund, Rosey will explain the refund calculation, including the effect of the Duo saving, before the return is completed.

Nothing in this section limits a remedy required by Australian Consumer Law.

10. Promotions

A Rosey promotion may have its own eligibility requirements, dates, stock limits, product exclusions or redemption instructions. Those specific conditions form part of these Terms for that promotion.

Unless stated otherwise, promotional codes must be applied before checkout is completed, cannot be exchanged for cash and cannot be applied retrospectively.

Rosey may correct or end a promotion where reasonably necessary because of an error, misuse, fraud, legal requirement or stock issue. We will not remove a benefit already included in an accepted order unless an appropriate remedy is provided.

11. Mental health contribution

$1 from every Rosey product sold supports mental health.

Rosey records and donates the contribution quarterly to a mental health charity selected by Rosey. The contribution is made by Rosey and does not add to the customer’s purchase price.

Unless Rosey expressly announces a formal partnership, this commitment does not imply that a recipient charity sponsors, endorses or is formally partnered with Rosey. Each formula within an eligible Rosey Ritual Duo counts as one Rosey product for the contribution.

12. Accounts and reviews

If Rosey offers customer accounts, you are responsible for keeping your login details confidential and for activity carried out through your account. Tell Rosey promptly if you believe an account has been accessed without permission.

If you provide a review, comment, image or other material for possible publication, you confirm that:

• it is yours or you have permission to share it
• it is accurate to the best of your knowledge
• it does not infringe another person’s rights or reveal their private information
• it is not unlawful, abusive, misleading or submitted in exchange for an undisclosed incentive

You retain ownership of your original material. You give Rosey a non-exclusive, worldwide, royalty-free licence to reproduce, format and publish it in connection with Rosey.

Rosey may choose not to publish or may remove material for a reasonable moderation, legal or operational reason. Rosey will not edit a customer review in a way that changes its meaning.

Do not send detailed medical records or the contents of private Rosey Skin Journal entries through a public review or general contact form.

13. Intellectual property

The site and its contents, including Rosey names, trade marks, product names, copy, photography, video, graphics, packaging, software and design elements, are owned by or licensed to Rosey and protected by applicable intellectual-property laws.

You may view the site and save or print a reasonable copy for personal, non-commercial use. You must not reproduce, sell, adapt, publish, distribute or commercially exploit Rosey content without written permission, except where the law permits.

14. Third-party services

Rosey uses third-party services for functions including ecommerce, payments, communications, analytics and delivery. Those providers may have their own terms and privacy practices.

Rosey is not responsible for a third-party site or service merely because it is linked from roseyskin.co. This does not exclude any responsibility Rosey has under applicable law for the services it chooses to use.

15. Privacy

Rosey’s Privacy Policy explains how personal information is collected, used, disclosed and protected across the online store, communications and Rosey Skin Journal. Personal information will be handled as described in that policy and in any collection notice shown when information is requested.

Rosey does not collect or read the contents of private Rosey Skin Journal entries. Rosey does collect email addresses through Klaviyo and limited pattern and usage data as described in the Privacy Policy.

16. Website availability and access

Rosey aims to keep the site accurate, secure and available, but uninterrupted access cannot be guaranteed. We may suspend or limit a feature where reasonably necessary for maintenance, security, fraud prevention, legal compliance or service-provider disruption.

Rosey may restrict or end access to an account or site feature because of fraud, unlawful conduct, a serious or repeated breach of these Terms, a security risk or a legal requirement. Where appropriate and lawful, we will provide notice and an opportunity to address the issue.

Ending access does not remove rights or obligations relating to an order already accepted, payment already made, intellectual property, privacy, liability or a matter that by its nature continues.

17. Liability

Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified.

To the extent permitted by law, Rosey is not responsible for loss caused by:

• using the site or a product contrary to supplied directions or warnings
• information you provide that is inaccurate or incomplete
• an event outside Rosey’s reasonable control, except to the extent Rosey remains responsible under applicable law
• a third-party site or service Rosey does not control, except to the extent Rosey remains legally responsible for selecting or using that provider

This section applies only to the extent Rosey is not otherwise responsible under applicable law.

18. Changes to these Terms

Rosey may update these Terms to reflect changes to the store, products, service providers or law. Updated Terms will be published with a new last-updated date and apply from their stated effective date.

A change will not retrospectively remove rights attached to an order already accepted. If a change materially affects an account or ongoing service, Rosey will provide notice where reasonably practicable or legally required.

19. General terms

If a provision of these Terms is invalid or unenforceable, it will be read down or removed only to the extent necessary. The remaining provisions will continue to apply.

If Rosey does not immediately enforce a provision, that does not waive the provision or a related right.

These Terms, together with the product page and policies expressly incorporated into them, form the agreement relating to your use of the site and purchases from Rosey.

These Terms are governed by the laws of Victoria, Australia. You and Rosey submit to the non-exclusive jurisdiction of the courts of Victoria and courts entitled to hear appeals from them. This does not prevent you from relying on rights available in another jurisdiction where those rights apply.
